I am default on my Sears card. In which, the account is in collections with Allied Interstate. On 2/24/2005, I recieved a call from them (allied interstate) stating that I could settle the balance for $685.

I told them I did not have the money right then to pay it in full, so he (the representative) said if I give him my checking account # that I could pay the $200 which I agreed to. Then make installment payments until the $685 was set. I told him to take the $200 out of my account on Monday 2/28/05.

They took the full $685 out of my account, in which I needed because my daughter was in the hospital & I was not working so that was bill money & for her medicine. I called allied on 3/2/05 and spoke with Erin Washington to make a complaint. After we had words, she hung up on me. They made me feel like I lied about the whole conversation.

In which I didn't. I wanted to hear a recording of a phone conversation, Erin said in 48 hrs I could hear one if I was going to pay the full balance which was $1462.54. Then she acts like she is miss perfect because she has A-1 credit.

So she felt like I was beneath her because I hadn't paid a bill. Most people just get in bad situations.

Here it is 2:40 am and I am worried about the foreclosure proceedings on my son and daughter-in-law and my 2 grand children losing their home. I discovered 2 days ago that my son is behind two months on his mortgage payments and on January 24, 2007, their home will be foreclosed on. Ever since America 's Servicing Company took over their loan in July 2006, it's been an uphill battle to get them to credit their payments on time. Even though they have a proof of delivery receipt, America 's Servicing Company will not credit their account and late fees are accuring. I have read on this website everyone's horrible dealings with this company and I'm pretty scared for my son and his family. My husband and I will help them to get back on their feet and bring them up-to-date but I fear this is going to cost us alot of money because of the company we are dealing with. Has anyone been successful in getting a straight answer from this company ? Is there no recourse for families trying to make ends meet and having excessive fees on top of paying a mortgage? Can anybody help me to help my son and his family? I'm about to embark on a battle with ASC and hopefully find the proper authorities to address the situation. Losing your home is devastating to anyone!!!
